PREAMBLE
This agribiomix.com website belongs to the company HOPSTOCK SASU
Placing an order implies unreserved acceptance of the conditions of sale and prices indicated on the AGRIBIOMIX website. We reciprocally undertake to respect the obligations incumbent upon it. These conditions apply exclusively to all orders placed via the agribiomix.com website, whether online or by telephone.
Pricing:
All prices are quoted inclusive of tax (V.A.T. included at 5.5%, 10% or 20% depending on the product and excluding shipping costs).
Price fluctuations cannot give rise to any compensation.
For example, an order placed on D-day cannot benefit from a more advantageous rate implemented on D+1.
SHIPMENTS
Orders paid by bank transfer will only be dispatched once our bank has confirmed that payment has been received.
Warranty and litigation:
Unless otherwise agreed, AGRIBIOMIX cannot be held responsible for the death of the plants delivered, due to factors beyond our control.
1. ACCEPTANCE OF CONDITIONS
The customer acknowledges having read, at the time of placing the order, the general conditions of sale set out on this screen and expressly declares accepting them without reservation.
The present general conditions of sale govern the contractual relations between AGRIBIOMIX and its customer, both parties accepting them without reservation. These general terms and conditions of sale shall prevail over any other terms and conditions appearing in any other document, except in the event of prior, express and written derogation.
2. PRODUCTS
The photographs and data sheets illustrating the products are not contractually binding. AGRIBIOMIX cannot be held responsible for any errors, inaccuracies or omissions.
3. PRICE
Prices are expressed in euros on agribiomix.com, the prices indicated on the product sheets do not include shipping costs, unless specified. Shipping costs vary according to destination country.
The total amount indicated in the order confirmation is the definitive amount, expressed inclusive of all taxes (TTC), including VAT for France and E.E.C. countries. It includes the price of the products, handling costs, packaging and preservation of the products, and transport costs.
4. ORDER
Automatic recording systems are considered as proof of the nature, content and date of the order. AGRIBIOMIX will confirm acceptance of the order to the customer at the e-mail address provided. The sale will only be concluded on receipt of your payment.
All orders will only be considered definitive after AGRIBIOMIX has confirmed them by sending a confirmation e-mail to the customer.
In the event of a dispute, AGRIBIOMIX reserves the right not to honour the order if the customer is unable to provide confirmation by e-mail.
AGRIBIOMIX reserves the right to cancel any order from a customer with whom there is a dispute concerning the payment of a previous order.
Orders cannot be dispatched until full payment has been received.
Orders are prepared as far as stock conditions allow. In the event that a product is temporarily unavailable, AGRIBIOMIX may replace it with an equivalent product or one of greater value, or offer the customer the choice of another item of equivalent value or a refund for the missing item.
The information provided by the purchaser when placing an order is binding, including in the case of orders placed by telephone: in the event of error, imprecision or omission in the recipient’s details, AGRIBIOMIX cannot be held responsible for the impossibility of delivering the purchaser’s order. Thus, the customer will have to pay the shipping costs again if the address entered on the order form is incorrect or incomplete. If an error is detected by the customer, it must be reported within 24 hours of the order form being issued.
5. PAYMENT
The amount invoiced to the customer is the amount indicated on the order confirmation. This amount is payable in cash on the day the order is placed. Orders will only be dispatched once our bank has confirmed payment.
Payment is by :
A – by credit card bearing the CB symbol
SECURE ONLINE PAYMENT allows you to pay via the “Stripe” and “Paypal” online payment services.
The customer’s bank details travel directly from his computer to his bank in an encrypted format using SSL technology, the most commonly used technology for online payments today. This information does not pass through the AGRIBIOMIX site and cannot be retrieved by the latter in any way.
The order validated by the customer will only be considered effective once the relevant bank payment centers have given their approval. In the event of refusal by the said centers, the order will be automatically cancelled and the customer will be informed by e-mail.
B – Payment by cheque
If the customer is unable to pay by credit card or bank transfer, he may exceptionally request payment by cheque by sending his order to contact@. Once the order has been pre-confirmed by AGRIBIOMIX, he may send a cashier’s cheque by post or deliver it personally. The customer must send us his cheque by post, made payable to “S.A.S. HOPSTOCK”, together with the references of his order.

C – Payment by bank transfer
The customer must make the transfer to the bank details indicated on our site, taking care to quote the order references. The customer’s order will not be considered effective until our bank has credited us. Transfer charges are the sole responsibility of the customer.
In the event of incomplete payment, the order will not be processed and AGRIBIOMIX will inform the customer.
If the customer wishes to cancel the order after payment of a deposit, the deposit cannot be reimbursed. AGRIBIOMIX and the customer will therefore have to find an amicable solution which may take the form of a partial reimbursement, delivery of goods corresponding to the amount already paid or substitution by other products.
In the event of an unidentified payment, AGRIBIOMIX will wait for the customer to come forward. It is therefore important for payments by bank transfer or cheque that the order references are specified.
AGRIBIOMIX reserves the right to refuse any order from a customer with whom a dispute exists.
As part of its anti-fraud policy, AGRIBIOMIX may request proof of identity and/or address from its customers. This request will be made by email, and the customer will have a maximum of fifteen days to respond. After this period, the order will be cancelled.
6. DELIVERY
Delivery will be made by colissimo, GLS, or other carriers of our choice.
A – Deliveries by Colissimo or GLS
In the case of delivery by Colissimo, if the customer is not at home on the day of delivery, he has fifteen days to collect it from his post office. After this period, the parcel will be returned to AGRIBIOMIX and the customer will have to pay the delivery charges again for the order to be reshipped.
In the case of delivery by GLS, if the customer is not at home on the day of delivery, the deliveryman will leave a calling card. The customer must then contact the delivery agency to reschedule a new delivery.
In the case of delivery by Colissimo or GLS, AGRIBIOMIX will inform you by e-mail when your order has been dispatched. A tracking link enables customers to follow their parcel.
B – Deliveries by carriers other than Colissimo or GLS
In the case of deliveries by carrier, AGRIBIOMIX or the carrier itself contacts the consignees for delivery.
Delivery times are given as an indication, and any delays do not entitle the purchaser to claim damages. However, if delivery times exceed those stated, the customer must inform AGRIBIOMIX so that a check can be made with the appointed carrier.
7. CANCELLATION
For all items other than Plants :
The buyer has 14 days from the date of delivery to withdraw from the contract. He must inform AGRIBIOMIX of his decision in writing (letter, e-mail, fax). He/she must inform AGRIBIOMIX customer service of his/her wish to activate his/her right of withdrawal.
The buyer must return the goods to AGRIBIOMIX by his own means and at his own expense.
In the event of the buyer exercising his right of withdrawal, AGRIBIOMIX is obliged to reimburse the sums paid by the customer, free of charge. Reimbursement is due within a maximum of 14 days following receipt and inspection of the returned goods.
In the event of an exchange or refund, new items must be returned in their original packaging, undamaged, accompanied by any accessories, instructions for use and documentation, to the following address: HOPSTOCK, 2131 route de Merville, 59190 HAZEBROUCK
For all plants and perishable items:
The buyer has 7 days from the date of delivery to withdraw from the contract. He must inform us of his decision in writing (letter, e-mail, fax).
After agreement by AGRIBIOMIX, the purchaser shall return the goods at its own expense, after ensuring that these items will be able to travel under the same conditions as they were delivered.
8. DISPUTES
This contract is governed by French law. AGRIBIOMIX cannot be held responsible for damages of any kind, whether material, immaterial or physical, which may result from malfunction or misuse of the products sold. The same applies to any product modifications resulting from manufacturers.
AGRIBIOMIX’s liability will, in any event, be limited to the amount of the order and will not be held liable for simple errors or omissions that may have occurred, despite all precautions taken, in the presentation of the products.
In the event of a dispute, an amicable solution will always be sought.
9. GUARANTEE
Plants are delivered in accordance with applicable production standards and practices.
The seller guarantees to supply the buyer with goods that are fair, healthy and merchantable, and that are in line with the state of the art at the time of production.
However, it’s important to remember that plants are living organisms.
Regardless of the customer’s good care and the quality of the plants delivered, many external factors can thwart the success of a plantation.
Consequently, as the recovery of plants and the results obtained depend not only on the quality of the products delivered, the seller cannot guarantee recovery, even after offering advice and suggestions.
Commitment to successful planting
All the plants offered are nursery plants. They therefore follow the natural life cycle under exactly the same conditions as in the field. All plants benefit from cultivation lasting from several months to several years before being dispatched. You’ll receive them in the best possible conditions for optimum growth.
However, AGRIBIOMIX wishes to support its customers in the success of their plantations, and any request concerning the condition of a plant arising after planting will be studied with our professionals in order to deal technically and commercially with the problem encountered.
In this context, we may ask you to provide photos and/or fill in a questionnaire.
10. LEGAL INFORMATION
The personal information collected for distance selling purposes is compulsory, as this information is essential for processing and routing orders, and drawing up invoices and warranty contracts.
Failure to provide this information will result in the order not being validated. The customer has the right to access, modify, rectify and delete data concerning him/her (article 34 of the French law of January 6, 1978). In addition, AGRIBIOMIX undertakes not to communicate, either free of charge or in exchange for payment, customer details to third parties.
